Ever have the urge to keep your kids in their rooms for the rest of their lives.  I know it’s not possible and probably against the law.  But, when I see stories like this I don’t want my kids to grow up and drive, or even walk near a street.

The Milwaukee Journal Sentinel reported about a Kenosha car accident where two people, a mother and son, were killed when another driver rear ended them.  The other driver hit them while they were outside the car trying to change a tire.  The mother and son were parked on the side of the interstate. 

Understand why I want my kids to stay in their room forever?

Serious Injuries…What About Tomorrow? August 15, 2008

In almost all auto accident, motorcycle accident, dog bite or other personal injury cases an insurance company will ask that the injured victim sign a Release of All Claims.  That document means exactly what it says.  It gets the insurance company off the hook for ALL claims (i.e. injuries, wage loss, mileage etc.), past, present or future.

A Release may have language similar to the following:

“For and in consideration of the sum of $____________cash in hand paid, the receipt and sufficiency of which is hereby acknowledged, the undersigned (name of plaintiff) does hereby release, acquit and forever discharge (name of defendant and insurance company) from any and all losses, injuries, claims, demands, actions, causes of action, payments, costs, expenses, damages, liability, or grievances of any nature whatsoever which he/she has had, which he/she may now have, or which he/she may hereafter have, which in any manner pertain to, relate to, or arise from any personal injury known and unknown, property damage, known and unknown, or any other loss of any nature whatsoever sustained as a result of the aforesaid vehicular accident which occurred on or about (date) involving the vehicle driven by said defendant and the vehicle driven by said plaintiff.

You never want to sell yourself short, especially when talking about your well being.  Injuries may linger on and on. If you accept a settlement days after the collision but don’t feel 100% you probably won’t be able to get your next doctor’s visit and the lost wages and mileage paid by the at fault insurance company.  Keep that in mind when you are dealing with your “friends” in the insurance industry.

Insurance companies aren’t able to build multi-million dollar buildings, gigantic water falls, balls of art and other expensive things by giving away compensation for injuries.  Their job is to pay as little as possible.  A personal injury attorney’s job is to make sure an injured party obtains compensation for everything that the law allows.  That includes past and FUTURE medical expenses.

Ever wonder why a whole bunch of kind-of-related web pages will show up when you search on google or yahoo.  For example, when you type “Wisconsin Dog Bite Attorney” attorneys from Illinois, Michigan and California pop up in your results.  (Quick hint: Make sure you read the entire web page and know where your attorney is licensed.  Or, when you call ask if they have the ability to file a lawsuit in your state.)

I think the reason is embedded keywords.  You can’t see them unless you look at the “source” of the web page.  I’ve cut and pasted from a few websites that came up when I searched for “Wisconsin Dog Bite Attorney”.

I thought the content was interesting:

Just Go Ahead and Call… August 7, 2008

When you are the victim of a motorcycle, car or truck accident and need a vehicle don’t be shy about getting a rental.

I do NOT recommend you give a statement to the at-fault insurance company.  I do recommend you get the claim number and telephone number for the at-fault insurance company’s adjuster.  Then call Hertz, Enterprise or the local rental company in your area.  Tell the rental company you’re the victim of a motor vehicle collision and give them the claim number and ajduster’s telephone number.  The rental company will then confirm this info and, more often than not, put you into a rental on the spot.

I almost always handle the property damage settlement for free.  I get paid from the bodily injury (pain and suffering, medical expenses, lost wage and mileage etc) portion of the claim. 

If you call soon after the collision I’ll be happy to guide you in the right direction.

This is more of a “For Your Information” post. 

I travel almost everwhere in Wisconsin for my clients.  If you check out Groth’s website you’ll see that we’ve handled cases in almost every county in Wisconsin.  So, if a client is located in Marinette will they have to drive to Milwaukee to meet with me?  NO.  If necessary I’ll be on the road to meet in Marinette. 

In most situations the case can be handled over the phone.  For example, I’m handling cases for a number of people in Chicago and a few in Florida.  I don’t fly to Florida or take the train to Chicago to meet with them.  The phone and email work just fine. 

Don’t worry about where in Wisconsin you happen to live or happen to have been injured.  If it is important to meet at the scene of the incident I’ll be there.

I had the privilege to help a woman injured after she was struck by a multiple drunk driver.  Luckily, her injuries were not severe.  She is still with us and doing much, if not all, of what she could do before the collision. 

The at fault insurance company did NOT exclude punitive damages.  This is rare.  Very rare.  The vast majority of the time insurance companies that write policies in Wisconsin specifically exclude any payment of punitive damages for their insureds. 

It is important that you check.  You may just find that needle in the haystack.  In this recent case it was a great benefit to my client. 

You’ve probably discovered that I don’t care for multiple drunk drivers.  If you or your attorney want assistance against a Wisconsin drunk driver that injured you feel free to call me.  I’d be happy to review the policy of insurance to see if you can obtain punitive damages from the drunk driver’s auto insurance.

By the way, don’t give up if insurance doesn’t cover punitive damages.  Make sure you check into the assets of the driver that caused the auto accident.

Under Doctor’s Care… July 30, 2008

It seems simple and I say it a lot:  Follow your doctor’s advice.   If after an auto accident you are told to not pick up certain things that way 15 or more pounds, then don’t do it.  No matter what some may say, everyone wants the victims of car accidents to get better fast.   You pay the doctor big money to advise you how to get better fast.

Your doctors know what they are doing.  Follow their advice.  If you are on work restrictions then follow them.  If you are to “take it easy” then do it.   There are always going to be exceptions, and I understand that.  But, after an auto accident and before you decide to go do something ask yourself what your physician would say.

Wisconsin’s Dog Bite Law July 28, 2008

It must be summer.  I’ve been talking with a lot of new clients injured by dogs.  For everyone’s information below I’ve linked to and posted Wisconsin’s Dog Bite Law (Sec. 174 Wis. Stats.)

When a dog causes injury to a person for the first time (“without notice”):

“the owner of a dog is liable for the full amount of damages caused by the dog injuring or causing injury to a person, domestic animal or property.”

When a dog owner knows that a dog has caused injury in the past and the dog causes injury again (“after notice”):

“the owner of a dog is liable for 2 times the full amount of damages caused by the dog injuring or causing injury to a person, domestic animal or property if the owner was notified or knew that the dog previously injured or caused injury to a person, domestic animal or property.”
