DePuy ASR Hip Replacement Recalled September 8, 2010

Johnson & Johnson, and its DePuy Orthopaedics subsidiary, announced last week that it is recalling parts used for hip replacements. At issue is the high rate of repeat surgeries needed by people who have received the parts. An estimated 93,000 people will be affected by Johnson & Johnson’s latest product recall.

Affected hip replacement parts involved in the recall include the DePuy ASR XL Acetabular System and the DePuy ASR Hip Resurfacing System. Patients who reported problems in the first five years and had revision surgery reported a variety of symptoms, including pain, swelling and problems walking. Other symptoms that may indicate a serious problem with the hip replacement parts include:

Loosening – when the implant does not stay attached to the bone in the correct position
Fracture – where the bone around the implant may have broken
Dislocation – where the two parts of the implant that move against each other are no longer aligned
Metal debris – where metal particles from the component parts moving together spread around the hip area.

I came across this little game on while reading the New York Times and thought it was fun. This feature on the Times website lets you compare your feelings with the way the Supreme Court has ruled on a 6 recent cases. It will also show you what percentage of the American Public agrees with you. At the end, it even tells you which Justice you would vote with most frequently.

Double Damages for Dog Bite Cases August 3, 2010

Last week a Wauwatosa woman was attacked by a dog with a violent history. The dog caused serious injury to the woman’s ankle. In May of 2009 the same dog attacked a toddler, biting him in the face. The story can be found here.

In a personal injury cases involving a dog bite, evidence of prior incidents regarding the same dog can not only be one of the most important pieces of evidence to prove that the owner is liable for the victims injuries, but according to Wisconsin law, it can mean that the victim is entitled to twice the amount of actual damages. Wisconsin Statute 174.02 states that an owner of a dog who was notified or knew that the dog had previously injured a person is liable for two times the amount of damages.

The Wisconsin Law Journal recently highlighted a Groth Law Firm, S.C. car accident settlement in Milwaukee County.  The case involved a rear end collision where the injured victim’s permenant injury was/is tinnitus.  The past medical bills were approximately $9,000.00.  The settlement totalled $95,000.00 (Ninety Five Thousand and 00/00).
