I’m speaking at the Wisconsin Solo and Small Firm Conference that will be held at the Kalahari Resort in Wisconsin Dells.  The conference will take place October 23-25, 2008. 

Tomorrow is the LAST day for the early bird registration discounts.  You can certainly register and reserve a room at a later date but you’ll lose the discount.

 UPDATE: I just reserved our rooms.  You gotta check out the kalahari’s website.  I hate to sound like an ad but for $139 a night (plus tax) you get a room with a kitchen, king sized bed and sofa sleeper, two tvs, patio and 4 passes to the water park.  Can’t beat it.  I hope you can join us at the conference.

When you are the victim of a motorcycle, car or truck accident and need a vehicle don’t be shy about getting a rental.

I do NOT recommend you give a statement to the at-fault insurance company.  I do recommend you get the claim number and telephone number for the at-fault insurance company’s adjuster.  Then call Hertz, Enterprise or the local rental company in your area.  Tell the rental company you’re the victim of a motor vehicle collision and give them the claim number and ajduster’s telephone number.  The rental company will then confirm this info and, more often than not, put you into a rental on the spot.

I almost always handle the property damage settlement for free.  I get paid from the bodily injury (pain and suffering, medical expenses, lost wage and mileage etc) portion of the claim. 

If you call soon after the collision I’ll be happy to guide you in the right direction.

I had the privilege to help a woman injured after she was struck by a multiple drunk driver.  Luckily, her injuries were not severe.  She is still with us and doing much, if not all, of what she could do before the collision. 

The at fault insurance company did NOT exclude punitive damages.  This is rare.  Very rare.  The vast majority of the time insurance companies that write policies in Wisconsin specifically exclude any payment of punitive damages for their insureds. 

It is important that you check.  You may just find that needle in the haystack.  In this recent case it was a great benefit to my client. 

You’ve probably discovered that I don’t care for multiple drunk drivers.  If you or your attorney want assistance against a Wisconsin drunk driver that injured you feel free to call me.  I’d be happy to review the policy of insurance to see if you can obtain punitive damages from the drunk driver’s auto insurance.

By the way, don’t give up if insurance doesn’t cover punitive damages.  Make sure you check into the assets of the driver that caused the auto accident.

It seems simple and I say it a lot:  Follow your doctor’s advice.   If after an auto accident you are told to not pick up certain things that way 15 or more pounds, then don’t do it.  No matter what some may say, everyone wants the victims of car accidents to get better fast.   You pay the doctor big money to advise you how to get better fast.

Your doctors know what they are doing.  Follow their advice.  If you are on work restrictions then follow them.  If you are to “take it easy” then do it.   There are always going to be exceptions, and I understand that.  But, after an auto accident and before you decide to go do something ask yourself what your physician would say.

I’ve battled with insurance companies recently over the loss of the use of my client’s vehicle.  When someone is involved in a car accident and their car is out of commission it is a big inconvenience.  The law in Wisconsin says that this “loss of use” must be compensated.  It does NOT matter whether or not a rental vehicle was obtained.

So, let’s say Bob is involved in a motorcycle accident.  His bike is a total loss.  It’s sitting in his garage because the at-fault insurance company hasn’t come out to look at it yet.  In the meantime he has to drive his “winter car”. 

Bob didn’t suffer any out of pocket loss.  He didn’t rent a vehicle or didn’t have to hire a taxi.   But, he lost the use of his vehicle.  He was certainly inconvenienced by the collision.  The law says that the at-fault party must pay for this loss of use and inconvenience.  (Hellenbrand v. Hilliard 2004 WI App 151, para. 34).

The Groth family will be conducting our annual reading of the Declaration of Independence today.  I’m sure our kids are going to get sick of this when they are older.  But for now, I’m able to keep them captive long enough so at least a little bit of patriotism sinks in.

Speaking of Cribs June 27, 2008

What a coincidence!  The Consumer Product Safety Commission has recalled the Stanley Furniture Company’s 2nd Nature Built to Grow Crib set. When the mattress support is in the middle setting the space between the middle mattress and the crib posses an entrapment hazard for infants.  In other words kids could get their head stuck in the crib and suffocate.

The CPSC has pictures of the crib on its website.

Be safe. If you own this crib make arrangements for your child to sleep somewhere else right away.  It’s not worth the risk of injury.
